Conditions of Use

1 – INTRODUCTION/RECITALS
These Terms of Use are stipulated between the User of the website (hereinafter referred to as “User”) and Lignano Pineta SpA, with registered office in Viale a Mare, 7 – 33054 Lignano Sabbiadoro near Pineta (UD), Italian Economic and Administrative Index (REA) UD 52607, VAT IT00167050301 (hereinafter referred to as Lignano Pineta). The website “Shop Pineta Art” is accessible at the URL https://www.lignanopineta.com/shop-pineta-art and enables users to benefit from the functionality described in article 2 below.
The use of the site is permitted only for private purposes; it is forbidden to use the site for commercial reasons or otherwise as part of any activity for commercial purposes. 2 – SITE FUNCTIONALITY
The Site allows the User to:

• to find out more about the items and services offered by Lignano Pineta SpA;
• make purchases in accordance with the terms provided for in the General Conditions of Sale of the Site.

The list of features is provided for guidance only and is not exhaustive. Lignano Pineta SpA reserves the right to add or remove functionality, temporarily or permanently, without the consent of the User.

3 – SITE TERMS OF USE
3.1 The Site is reserved for persons of 18 years of age identifiable as private persons as well as for minors under the age of eighteen who have been authorized by a parent or those in loco parentis. Notwithstanding the above, Lignano Pineta SpA strongly encourages anyone with responsibility for a minor under the age of eighteen to monitor the use of the Site by the same.
3.2 Access to certain services offered by the Site may be subject to the creation of an Account, for the creation of which the User may be requested to provide information that permits the identification of the same. The User undertakes to transmit exact and complete data about their identity and to refrain from usurping the identity of others. In the event that this commitment is not respected, Lignano Pineta SpA reserves the right to not confirm, to suspend or to delete the Account.

4 – INTELLECTUAL PROPERTY
The Content of the Site respects intellectual property rights, with particular reference to copyright, designs, trademarks, domain names, patents, know-how, software or databases. Lignano Pineta SpA is the owner of all the Content of the Website and of the rights associated with it. In respect of which content, Lignano Pineta SpA grants the User consent for non-exclusive and revocable use of the Site. Such consent does not grant Users any rights, in particular, the right of commercial exploitation of the above-mentioned Content.

5 – LIABILITY
5.1 Liability of Lignano Pineta SpA
Browsing and use of the Site shall be at the sole liability of the User. Lignano Pineta SpA cannot be held liable for damages arising from access or use of the Site and the information contained therein. The User is hereby notified that it is possible that Lignano Pineta SpA may temporarily interrupt access to the Site for technical reasons related to maintenance and henceforth waives their right to make any claim for compensation. Lignano Pineta SpA shall under no circumstances be held liable for:

• any network malfunctions that inhibit the proper functioning of the Website,

• any software malfunction,
• any consequences arising from computer viruses, bugs, faults or malfunctions,

5.2 Liability of the User
By using the Site, the User agrees to release Lignano Pineta SpA from any liability and to hold them harmless from any damages, costs and charges, whether direct and indirect, arising from:
• any activity related to participation on the Site contrary to these General Terms;
• violation of these Terms of Use of the Site.

7 – ENTIRE AGREEMENT CLAUSE
Where one or more clauses of the General Terms of Use are declared invalid as a result of the application of a law, regulation or final judicial or administrative decision, all other clauses will continue to have legal effect.

8 – APPLICABLE LAW/DISPUTES
These General Terms of Use shall be governed by Italian law.
